What is probate?


  1. Probate is the judicial process by which the decedents estate is valued, beneficiaries are determined, a person in charge is declared (Executor), and the estate is legally distributed.

  2. The official proving of a will and/or establishing the validity of a will (Testate).

  3.  Intestate: Occurs when there is no will. In California, the assets are likely to be awarded to the next of kin (spouse and/or kids).

  4. The law will determine who will inherit the estate.
